A Las Vegas woman, who prosecutors allege was nearly killed by her former casino floor supervisor, has filed a lawsuit against Virgin Hotels, accusing the company of negligence.
Fausto Pozuelo Sarria, 43, was sentenced to a two-year prison sentence for assault with a deadly weapon in September 2024. Nichole Roberts, 38, his victim, reported that she experiences migraines, vertigo, and Post-Traumatic Stress Disorder. On July 15, 2024, her existence was transformed.
“I will always remember that day,” Roberts said. “What [my family and friends] were going to think about me dying. I was mostly thinking that they were going to be disappointed that I let this happen to me with this guy.”
On the morning of July 15, 2024, Pozuelo Sarria, the table games floor superintendent at Virgin Hotels, arrived at Roberts’s residence. Roberts was employed as a card dealer at Virgin Hotels. Within weeks of her commencement in January 2024, the two initiated a romantic relationship.
Nevertheless, Roberts stated that she terminated the relationship upon discovering his substance abuse issues. Roberts’ termination was precipitated by an HR complaint that he submitted.
“On some level, I still almost feel bad for him that he got fired, and then I feel crazy because he tried to kill me for it,” Roberts said.
Pozuelo Sarria struck her over the head with a wine bottle on multiple occasions, punched her repeatedly, and strangled her until she lost consciousness.
A month following the August assault, he entered a plea of guilty. Clark County prosecutors stated that Roberts was fortunate to have survived during his sentencing on Sept. 23.
“This is a situation where this is a clear attempt murder. The defendant pled to a battery with a deadly weapon, but ultimately that’s a gift for him, because he’s lucky that she was able to stand here today and speak,” Clark County Chief Deputy District Attorney Sarah Overly said.
Pozuelo Sarria was sentenced to a prison term of two to ten years by Clark County District Court Judge Ronald Israel.
Pozuelo Sarria expressed regret for nearly murdering Roberts.
“What I did to the victim was wrong. My behavior was unacceptable and for that, I apologize,” Pozuelo Sarria said. He is currently incarcerated at the Southern Desert Correctional Center.
He acknowledged that he was using narcotics at the time of the assault on Roberts.
Roberts claimed that Virgin Hotels employees were aware of his drug use but chose to disregard it. Consequently, she filed a civil lawsuit against the hotel in November of last year, seeking $5 million in damages.
“Their negligence and ignoring all of these little factors made it so I almost got murdered,” she said.
Since the assault, she has refrained from returning to her position at Virgin Hotels. Virgin Hotels has attempted to have Nichole Roberts’ lawsuit dismissed; however, a Clark County District Court Judge has declined. A jury trial is scheduled for August 2026.
